These Terms and Conditions (“Terms”) govern the purchase and use of water supply, water tanker delivery, and related services provided by MK Water Suppliers (“MK Water Suppliers,” “we,” “us,” or “our”).
By placing an order, making a payment, or using our services, the customer (“Customer,” “you,” or “your”) acknowledges that they have read, understood, and agreed to these Terms.
MK Water Suppliers is engaged in providing water supply and water tanker delivery services primarily to residential, commercial, construction, institutional, and other eligible customers within our service areas.
Services are subject to availability, delivery location, water availability, tanker availability, accessibility, and operational conditions.
Customers may place service requests through our website, telephone, WhatsApp, or other communication channels officially accepted by MK Water Suppliers.
Customers are responsible for providing accurate and complete information, including:
Name and contact information;
Complete delivery address;
Required quantity of water;
Preferred delivery date and time; and
Any relevant access or delivery instructions.
An order will be considered accepted only after confirmation by MK Water Suppliers.
Prices may vary depending on the quantity ordered, tanker capacity, delivery location, distance, water availability, transportation costs, market conditions, and any additional services requested.
The applicable price will be communicated to the Customer before or at the time the order is confirmed.
Any applicable taxes, fees, or additional charges will be charged in accordance with applicable requirements.
Customers may make payments using the payment methods made available and approved by MK Water Suppliers, including supported online payment methods.
Payments made through third-party payment gateways or payment service providers may also be subject to the respective provider’s terms and conditions.
Customers are responsible for ensuring that the payment information provided is accurate and that they are authorized to use the selected payment method.
Where services are provided on approved credit terms, payment must be made within the period specified on the applicable invoice or as otherwise agreed.
MK Water Suppliers will make reasonable efforts to fulfill confirmed orders within the agreed or estimated delivery period.
Delivery times are estimates unless expressly confirmed otherwise. Delivery may be affected by circumstances including traffic conditions, water availability, tanker availability, vehicle breakdowns, road restrictions, weather conditions, government restrictions, emergencies, or other circumstances beyond our reasonable control.
Customers must ensure that the delivery location is accessible and that appropriate arrangements have been made to receive the water.
The Customer is responsible for:
Providing accurate delivery information;
Ensuring safe and lawful access for the delivery vehicle;
Providing a suitable receiving or storage facility;
Ensuring that the receiving location is ready at the time of delivery; and
Inspecting the delivery and promptly reporting any material issue.
MK Water Suppliers may refuse or discontinue a delivery where conditions at the location could reasonably create a safety, legal, or operational risk.
Customers wishing to cancel or reschedule an order should contact MK Water Suppliers as soon as possible before dispatch.
Orders cancelled before dispatch may be eligible for cancellation without delivery charges, subject to any costs already incurred in preparing the order.
If the delivery vehicle has already been dispatched, reasonable transportation, waiting, or cancellation charges may apply where such charges were previously communicated or agreed.
Where a Customer has made an advance or online payment and an order cannot be fulfilled by MK Water Suppliers, the Customer may be eligible for a refund of the applicable amount paid for the unfulfilled service.
Refund requests relating to duplicate payments, incorrect charges, cancelled orders, or unfulfilled services will be reviewed based on our transaction and delivery records.
Approved refunds will generally be returned to the original payment method where reasonably possible. Processing times may vary depending on the bank, card network, UPI provider, payment gateway, or other payment service provider involved.
No refund will ordinarily be provided for a service that has been fully delivered and accepted, except where required under applicable law or where MK Water Suppliers determines that a refund is appropriate after reviewing the circumstances.
If delivery cannot be completed because:
The Customer provided an incorrect address;
The Customer or authorized recipient is unavailable;
The premises are inaccessible;
The Customer’s storage facility is not ready; or
Delivery cannot safely or legally be completed,
the order may be rescheduled or cancelled, and reasonable additional delivery or waiting charges may apply where previously communicated or agreed.
MK Water Suppliers may maintain invoices, delivery challans, payment records, customer records, vehicle information, and other documentation relating to orders and deliveries.
Customers should retain their invoice, payment receipt, transaction reference, or delivery challan for their records and for resolving any service or payment-related concerns.
If a Customer believes that a payment has been charged incorrectly, the Customer should contact MK Water Suppliers promptly with the relevant order, invoice, receipt, or transaction details.
We will review the matter against our payment and delivery records and take appropriate action where an error is confirmed.
Customers should contact us before initiating a payment dispute or chargeback where reasonably possible so that we have an opportunity to investigate and resolve the matter.
MK Water Suppliers does not guarantee continuous availability of any particular tanker, delivery slot, quantity, or water source.
We reserve the right to decline, postpone, or modify a service request where fulfillment is not reasonably possible, subject to applicable law and any confirmed contractual obligations.
To the maximum extent permitted by applicable law, MK Water Suppliers shall not be liable for indirect, incidental, or consequential losses arising from service interruptions or delays caused by circumstances reasonably beyond our control.
Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.
MK Water Suppliers reserves the right to reject, suspend, or investigate transactions reasonably suspected to involve fraud, unauthorized payment activity, false information, misuse of our services, or other unlawful activity.
Additional verification may be requested where reasonably necessary to verify an order or payment.
Customer information collected in connection with orders, payments, deliveries, and inquiries will be handled in accordance with our Privacy Policy and applicable legal requirements.
Payment information processed directly by third-party payment service providers may also be governed by their respective privacy and security policies.
MK Water Suppliers may amend these Terms periodically to reflect changes in our services, business operations, payment methods, or applicable legal requirements.
The version published on our website at the time of the relevant transaction will apply, subject to applicable law.
These Terms shall be governed by and interpreted in accordance with the applicable laws of India.
Any dispute arising from these Terms or our services shall be subject to the jurisdiction of the competent courts applicable to MK Water Suppliers, unless otherwise required by applicable law.
